Colleen practices primarily in the areas of employment litigation, civil rights litigation, medical malpractice, and personal injury. She previously served as a law clerk intern for United States Magistrate Judge Thomas P. Smith.

Prior to joining Carmody, Colleen was an associate at the law firm of Donahue, Durham and Noonan P.C.

  • Volunteer for Madison Youth Sports programs in football, basketball, baseball, softball, and lacrosse.
  • Volunteer for Madison Public Schools, including assisting with school projects, presentations, fundraisers, and activities.

Experience

  • Second chair on District Court case involving claims of race and gender discrimination and retaliation by physician’s assistant. Dismissal by trial judge after conclusion of evidence.

  • Second chair on District Court case involving claims of disability discrimination. Defense verdict.

  • Second chair on Superior Court case representing defendant in a boundary dispute. Six-day trial ended in a plaintiff’s verdict in the amount of $280.00 after a demand of $40,000.00.

  • Assisted in the defense of an educational institution against a claim that defendant interfered with plaintiff’s ability to obtain employment for fifteen years after his termination. Plaintiff brought two lawsuits in District Court and one in Superior Court.  Defense judgments obtained in all three cases on motions to dismiss.  Three separate appeals, all affirmed.

  • Assisted in defense of an educational institution against claims of gender and disability discrimination, retaliation, and sexual harassment. Action withdrawn without payment following conclusion of discovery.

  • Assisted in independent investigation of employment discrimination claims asserted by employee of a prominent boarding school.

  • Assisted in the defense of several educational institutions in numerous Title IX claims brought by numerous students and faculty who had been disciplined for sexual misconduct.

  • Assisted in the defense of several educational institutions in numerous Title IX claims brought by students who had been disciplined for academic dishonesty.

  • Assisted in the defense of an educational institution against breach of contract, negligent misrepresentation, breach of the duty of good faith and fair dealing, and promissory estoppel claims following dismissal of a medical student. Summary judgment for defendant upheld on appeal.

  • Assisted in defense of an educational institution against a hybrid 301/duty of fair representation claim in connection with an alleged breach of the collective bargaining agreement. Summary judgment entered in favor of defendant.

  • Assisted in the defense of a major health care system against Superior Court medical malpractice action involving a hip replacement. Summary judgment entered in favor of defendant.

  • Assisted in the defense of a medical malpractice action involving delayed diagnosis of breast cancer. Plaintiff brought two lawsuits in Superior Court and one in District Court.  Defense prevailed on motion to dismiss in each case.
