The CT Department of Energy & Environmental Protection (DEEP) has finalized long-awaited “Release Reporting Regulations,” which define when and how discharges of oil, petroleum, and other reportable materials must be reported to the State. The new regulations, available here, became effective on Friday March 4, 2022.

Prior to these regulations, a broad statutory framework required reporting of all releases. So, the effect of these new regulations will be to reduce the types and number of events that are reportable to DEEP, and ultimately enhance the effectiveness of DEEP’s spill prevention division.

The regulations establish three categories of reportable quantities:

  1. 5+ gallons for oil and petroleum
  2. Any quantity of high-risk materials, and
  3. 1.5 gallons or 10 pounds of all other reportable materials.

The regulations further specify how to report, what information to provide, and the timeframe for reporting.
