Lawsuits and trials are not always necessary, and may be prudently avoided through the use of creative alternatives. Our litigators are trained and experienced in the development and use of various mediation and arbitration techniques.
Two members of our ADR Group, Jim Robertson and Anthony Fitzgerald, are frequently selected as mediators and arbitrators in matters involving corporate governance, probate issues, tort claims and commercial disputes. The types of matters that are referred to them include:
- A dispute between two law firms arising from the recruitment of a practice group
- Insurance coverage disputes
- Dispute between shareholders of a closely held business
- Commercial dispute between businesses with an important continuing relationship
- Claims of sexual abuse in a private school
All members of the Group have been appointed by both the federal and the state courts to serve as mediators and Special Masters. Indeed, another member of the group, Maureen Cox, chaired the federal court mediation program and is a leader of the state court special master's program.
