Regulatory Approvals

Carmody & Torrance has represented clients in the energy and utility industry before various state agencies for a number of years in connection with the construction of electric and gas transmission lines and other energy-related facilities. We have a long history before the Connecticut Siting Council, and its predecessor agency, the Connecticut Power Facilities Evaluation Council (PFEC), since the creation of the PFEC in 1972. Our attorneys have been involved in the siting of many of the major electric and gas infrastructure projects that have been constructed in Connecticut during this period. Carmody & Torrance also provides representation before other regulatory agencies. We have appeared before the Connecticut Department of Public Utility Control, the Connecticut Department of Environmental Protection and the Connecticut Department of Public Health on behalf of our energy and utility clients.

Because of our extensive experience, Carmody & Torrance attorneys are able to provide our clients with the guidance needed in making key decisions early in the stages of project development. We work as a team with our clients to secure required regulatory approvals in a timely, cost effective manner. Our goal is to provide our clients with the guidance they need to secure the regulatory approvals needed to meet their strategic goals.

Representative matters include:

  • Secure permits for electric transmission projects from the Connecticut Siting Council for the construction of a 345-kV loop serving Southwest Connecticut and the replacement of a 115-kV cable system between Connecticut and Long Island, including the defense of litigation challenging the regulatory approvals and representation before the Independent System Operator for New England in connection with cost allocation proceedings. We are working on the permitting of an electric transmission project that will include construction of new facilities in Connecticut, Massachusetts and Rhode Island.
  • Served as Connecticut counsel to a joint venture that is seeking to construct an interstate natural gas pipeline that will extend from central Connecticut and across Long Island Sound to New York.
  • Representation of several major gas transmission companies operating in the state in obtaining siting approval to construct their main lines and subsequent major additions to their facilities, as well as representation in environmental rule-making and enforcement proceedings.
  • Obtained the approval required from the Connecticut Department of Public Utility Control for the sale of real property of one our utility clients that was an integral element of a complex litigation settlement.
